Hit-And-Run Driver Charged With 2nd Degree Murder, Had 4 Previous DWI Charges

JOHNSTON COUNTY, N.C. -- Troopers have charged Hipolito Zamora Hernandez with second degree murder after he hit and killed a 7-year-old boy while allegedly driving drunk.

Hernandez, who is charged in the fatal hit-and-run death of a Cooper Elementary School student, was also charged in Johnston County with drunken driving at least four times since 2004, court officials said. Those previous charges were either dismissed or reduced, records show.

Hipolito Zamora Hernandez's background includes a one drunken driving arrest in 2004. That charge, according to the Johnston County Clerk of Court's Office, was dismissed. During his court appearance for a second DWI charge, Hernandez, 30, of Parktown Road, plead guilty only to reckless driving to endanger.

Court records show he also has an outstanding drunken driving charge from Dec. 2007 for drunken driving and driving left of the center lane. He also was set to appear in Johnston County's Traffic Court on May 23 for a charge of speeding.

Authorities determined Wednesday that Hernandez initially gave arresting officers a fake name. He now has been identified as Hipolito Hernandez, 30, of Parktown Road, North Carolina Highway Patrol officials said.

Hernandez initially told arresting officers he was Pollo Hernandez Rodriguez. According to Lt. Everett Clendenin, he has used several aliases in the past, often varying birth dates and middle names. At least one other charge was reported by the Johnston County Clerk's Office in 2001 against a man with Hernandez's name, but a different birthdate.

"He gave us only a name and we found out it wasn't correct," Lt. Clendenin said Wednesday. "It was a variation."

Local immigration officials Tuesday placed a detainer on Hernandez, a move that likely will get him deported after the disposition of the criminal charges against him, according to Johnston County Sheriff Steve Bizzell.

Sheriff's deputies partnered with the Immigration and Customs Enforcement to fingerprint and research Hernandez's criminal record after his Sunday arrest.

Troopers jailed Hernandez after he allegedly struck Marcus Lassister, 7, while he was crossing Heath Road near his grandmother's house. After hitting the boy with the car, he jumped from the car and ran, but was seen by a neighbor who reported his whereabouts to investigators.

Lassister immediately was airlifted to Duke Hospital, where hours later doctors pronounced him brain dead, according to Sgt. J.L. Gaskins of the North Carolina Highway Patrol. His family chose to remove him from life support Monday night, Lt. Gaskins said.

He remains in the Johnston County Jail under a $1 million bond.
