Fayetteville Skate Shop Sues Over Tree

FAYETTEVILLE, N.C. -- A tree covered in skateboards will be discussed in court.

The owner of Blount Street Skate Shop, Ross Roggio, has filed a lawsuit against the city of Fayetteville over a tree outside his shop.

About 200 pieces of broken skateboards, plus wheels are nailed to two trees outside the shop. There are also dozens of pairs of shoes hanging from the trees. City officials say the eye-catching tree is considered a sign and violates the city sign ordinance. Roggio was cited for the violation. 

Roggio's attorney, Susan Hyatt, said says it does not fit the city definition of a sign. The lawsuit asks the court to overturn the city's decision.

The city has not filed a response and no court date has been set.
